§341 Meeting QUESTIONS

 

Remember to answer the questions asked; the trustee does NOT need to hear your life story and the reasons for your filing for bankruptcy. The purpose of the meeting is to put you under oath so that you can affirm that the bankrupcy papers filed in this case were truthful and accurate. Your attorney CANNOT answer these factual questions for you and will say almost nothing at the meeting.

 

Do you swear or affirm to tell the truth, ther whole truth and nothing but the truth?

If you answer anything other than yes, then you should probably leave the meeting room. State your names and addresses for the record.

The trustee will then verify that your social security number and identification MATCH the filed bankruptcy documents. Names must be exact.

 

Have you read the bankruptcy sheet provided by the U.S. Trustee's office?Have your read the petition, statements and related documents that have been filed in your case? Are you familiar with them and are they truthful and accurate? Have you listed all your everyone to whom to you money? Have you listed all of your assets?

These are documents we prepared and you signed in our office. If you start looking clueless and then staring at your attorney, it doesn't help your case. These should be a yes, unless you lied.

 

Where do work? What is your income? How much do you spend monthly on Internet or gas for the car? When did you last use the credit cards? Are the house payments in default?

It is important that you be truthful but you should review the documents filed in this case so that your answers are similar to what the documents indicate.

 

Have you sold, transferred or given away any assets in the last 2 years? (10 years in Chapter 13)

Anything other than NO should be documented in the paperwork. This is an extremely important question.

 

Does anyone owe you any money? Have you seen an attorney for any reason other than this bankruptcy in the last 4 years? Can you sue anyone? Have you repaid any loans to any friends or family members in the last 2 years?
